Welcome to BenchBalancer. These Terms of Service ("Terms") govern your use of the BenchBalancer website and application (the "Service"). By accessing or using BenchBalancer, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using BenchBalancer, you confirm that:
- You are at least 18 years old, OR you have parental/guardian consent to use this service
- You have read and agree to these Terms of Service
- You have read and agree to our Privacy Policy
- You will comply with all applicable laws and regulations
2. Description of Service
BenchBalancer is a sports rotation management platform that helps coaches:
- Track and balance player playing time
- Manage team rosters
- Record match statistics
- Share live game updates with spectators
Important Disclaimer: BenchBalancer is a rotation management tool designed to assist coaches. It does not guarantee equal playing time outcomes. All coaching decisions, including player selection and substitution timing, remain the sole responsibility of the coach.
3. User Accounts
3.1 Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorised access to your account
- One person may not maintain multiple accounts to circumvent service limitations
4. User Responsibilities
4.1 Data Entry
When entering player information, you are responsible for:
- Ensuring you have appropriate consent to enter personal information of players, particularly minors
- Accuracy of all information entered
- Obtaining parental/guardian consent before entering children's information
4.2 Appropriate Use
You agree NOT to:
- Use the Service for any illegal purpose
- Enter false, misleading, or harmful information
- Attempt to gain unauthorised access to other users' data
- Interfere with or disrupt the Service
- Reverse engineer or attempt to extract the source code
- Use the Service to harass, abuse, or harm others
- Share account credentials with others
- Create multiple accounts to bypass limitations
5. Intellectual Property
5.1 Our Rights
BenchBalancer and all associated content, features, and functionality are owned by BenchBalancer and are protected by copyright, trademark, and other intellectual property laws.
5.2 Your Content
You retain ownership of the data you enter into BenchBalancer (rosters, match results, statistics). By using the Service, you grant us a limited license to store, process, and display this data solely for providing the Service to you.
6. Disclaimers and Limitations
6.1 No Guarantee of Equal Playing Time
BenchBalancer provides rotation suggestions and playing time tracking as a tool to assist coaches. We do not guarantee that using BenchBalancer will result in equal or fair playing time distribution. Coaching decisions are complex and depend on many factors beyond playing time.
6.2 Service Availability
- We strive to maintain 99.9% uptime but do not guarantee uninterrupted access
- The Service may be temporarily unavailable for maintenance or updates
- We are not responsible for data loss due to device issues, network problems, or browser limitations
6.3 Limitation of Liability
To the maximum extent permitted by law:
- BenchBalancer is provided "AS IS" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- We are not responsible for disputes between coaches, parents, players, or clubs
- We are not liable for any decisions made based on information provided by the Service
- BenchBalancer is provided free of charge; to the extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to AUD $100
7. Disputes Between Users
BenchBalancer is a tool and does not mediate disputes between:
- Coaches and parents
- Coaches and players
- Parents and clubs
- Any other parties
Disputes regarding playing time, team selection, or coaching decisions should be resolved:
- Directly between the parties involved
- Through your sporting club or association
- Through relevant sporting bodies or authorities
8. Account Suspension and Termination
8.1 By You
You may delete your account at any time through Settings → Delete My Account. This will permanently remove all your data.
8.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in abusive or harassing behaviour
- Use the Service for illegal purposes
- Attempt to circumvent service limitations
- Engage in fraudulent activity
- Share inappropriate or harmful content
We may provide notice before termination where practical, but reserve the right to terminate immediately for serious violations.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting updated Terms on this page
- Updating the "Last Updated" date
- Notifying you via email for significant changes
Continued use of the Service after changes constitutes acceptance of the updated Terms.
10. General Provisions
10.1 Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
10.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
10.3 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BenchBalancer.
11.4 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
